What the New ICE Deportation Policy Means

Officials with Immigration and Customs Enforcement (ICE) have begun the process of putting in place a policy that would fast-track the arrest, detention and deportation of undocumented immigrants who have been in the United States for less than two years. The expedited removal policy was initially blocked in 2019 by a preliminary injunction. In June 2020, however, the U.S. Circuit Court of Appeals for the District of Columbia lifted that injunction and allowed the new policy to go into effect. This has paved the way for ICE deportation proceedings to go forward with even less oversight and has put the lives and families of immigrants at risk.

Immigrants without the proper documentation may be arrested and detained by ICE or other federal immigration agencies. These immigrants must then usually be afforded a hearing with an immigration judge before being deported back to their home country. Because of the Trump administration’s crackdown on immigration, however, many immigrants could now be deported without any oversight by a federal immigration judge or a fair process.
